1. WHO WE ARE

1.1 The artsadeem.com website, the Artsadeem mobile applications and related services (the "Platform") are operated by Artsadeem Trading (ارت سديم للتجارة), a sole establishment licensed by the Department of Economy and Tourism in Dubai under Professional Licence No. 1615127 (activity: Portal — e-commerce marketplace), trading under the brand "Artsadeem" ("Artsadeem", "we", "us", "our").

2. DEFINITIONS

"Buyer" means a person who buys or enrols through the Platform. "Seller" means a verified artist, maker, publisher, instructor or organiser who offers items through the Platform. "Item" means an original artwork, a catalogue product (such as art tools or books), a course, or a ticket offered on the Platform. "Order" means a purchase placed through the Platform's checkout. "User" means anyone who visits or uses the Platform.

3. ACCEPTANCE OF THESE TERMS

3.1 By using the Platform, creating an account or placing an Order, you accept these Terms together with our Privacy Policy, Refund and Returns Policy and Shipping and Delivery Policy, which form part of these Terms.

3.2 We may update these Terms. The version published on the Platform at the time you place an Order applies to that Order. Material changes are announced on the Platform before they take effect.

4. ELIGIBILITY AND ACCOUNTS

4.1 You must be at least 18 years old (the age of full legal capacity in the UAE) to create an account, buy or sell. A younger person may only use the Platform under the supervision and with the consent of a parent or legal guardian, who is responsible for their use.

4.2 You must give accurate, current information, keep your password confidential and tell us immediately about any unauthorised use of your account. You are responsible for activity under your account.

4.3 We may suspend or close accounts that breach these Terms or the law, that give false information, or that put other users or the Platform at risk.

5. OUR ROLE AS A MARKETPLACE

5.1 Items are listed by independent Sellers, who set their prices and descriptions and ship their own items. Sellers are verified by us before they can sell.

5.2 Artsadeem operates the Platform, presents the listings, takes payment for every Order on the Seller's behalf, arranges shipping with our logistics partner, and pays Sellers after delivery.

5.3 In line with UAE consumer protection law, Artsadeem is your point of contact for any problem with an Order. You deal with us — we resolve complaints, returns and refunds and then settle the matter with the Seller.

6. LISTINGS, PRICES AND AVAILABILITY

6.1 Sellers must describe Items accurately, including medium, size, weight, condition and country of origin where relevant. Colours on screen may differ slightly from the physical Item.

6.2 Prices are set in UAE Dirhams (AED). Amounts shown in other currencies are approximate and for information only; you are charged the AED amount shown at checkout (or, for PayPal, the US Dollar amount shown at checkout).

6.3 Original artworks marked "one of a kind" exist once and are sold to the first Buyer who completes payment.

6.4 If an Item was listed with an obvious pricing or description error, or is no longer available, we may cancel the Order and refund you in full.

7. ORDERS AND CONTRACT

7.1 Your Order is an offer to buy the Items in your cart at the prices and shipping cost shown at checkout. The contract is formed when your payment is confirmed and we send you an order confirmation by email.

7.2 The Seller then confirms the Order and prepares it for shipping. If the Seller cannot fulfil the Order, we cancel it and refund you in full, including shipping.

7.3 You receive an electronic invoice/receipt for every Order. Keep it for returns and warranty purposes.

8. PAYMENT

8.1 You can pay by debit or credit card (processed by Stripe) or by PayPal. PayPal does not support AED, so PayPal payments are charged in US Dollars at the fixed rate of AED 3.6725 = USD 1; the amount is shown before you pay.

8.2 We never see or store your full card number. Payments are processed by PCI-DSS certified providers.

8.3 Value Added Tax: Artsadeem Trading is currently not registered for VAT in the UAE, so no VAT is charged. If we register, prices will be displayed inclusive of VAT and invoices will show the VAT amount and our Tax Registration Number.

8.4 We may cancel an Order, or hold it for verification, if we reasonably suspect fraud or unauthorised use of a payment method.

9. SHIPPING AND DELIVERY

Shipping is handled by Aramex. Shipping costs are calculated at checkout from the delivery address and the weight and size of each Item. Delivery times, international customs duties and delivery problems are covered in our Shipping and Delivery Policy.

10. RETURNS, REFUNDS AND DISPUTES

Your rights to return, exchange or be refunded, and how to report a problem, are set out in our Refund and Returns Policy. Nothing in these Terms limits your rights under Federal Law No. 15 of 2020 on Consumer Protection, Federal Decree-Law No. 14 of 2023 on Trading by Modern Technological Means or their implementing regulations.

11. COURSES, DIGITAL CONTENT AND TICKETS

11.1 When you buy a course you receive a personal, non-transferable licence to access its lessons and materials for your own learning. You may not copy, share, resell or publicly show course content, or share your account access.

11.2 Tickets for virtual exhibitions and events are personal to the ticket holder. Event details are set by the organiser; if an event is cancelled or materially changed, the Refund and Returns Policy applies.

11.3 Course completion certificates confirm completion of the course on the Platform only; they are not accredited qualifications unless the course page says otherwise.

12. SELLER TERMS

12.1 Becoming a Seller. Sellers must apply through the Platform, provide true identity and verification documents and be approved by us. We may refuse or withdraw approval at any time for good reason.

12.2 What may be sold. Sellers may only list Items they own or are authorised to sell. The following are prohibited: counterfeit or copied works presented as originals; Items that infringe copyright, trademarks or other rights; antiquities or cultural property without the required permits; Items whose sale or export is restricted or illegal in the UAE; offensive or indecent material; and anything else that breaches UAE law.

12.3 Listing accuracy. Sellers must give accurate titles, descriptions, images, prices, stock, condition and country of origin, and the packed weight and box size of each Item (these determine the shipping cost charged to the Buyer). Product and artwork listings are reviewed before publication. Any listing may be edited, suspended or removed if it breaks these Terms.

12.4 Fulfilment. Sellers must confirm new Orders within 2 business days and have the Item packed and ready for courier pickup within 3 business days after confirming (5 business days for original artworks that need professional packing). Items must be packed to survive transit, with fragile works protected and framed glass secured.

12.5 Commission and fees. Artsadeem keeps a commission on each sale, which is 15% of the Item price unless a different rate is shown in the Seller dashboard or agreed in writing. Shipping charges collected from the Buyer are used to pay the carrier.

12.6 Payouts. The Seller's earnings (sale price minus commission) become payable once the Order has been delivered and the Buyer's inspection period has ended without an open claim, and no earlier than 7 days after payment. Payouts are made in AED by bank transfer to the Seller's verified bank account (IBAN). Sellers must keep their bank details accurate.

12.7 Refunds and claims. Where a Buyer is refunded because an Item was defective, damaged by poor packing, not as described, not shipped or cancelled by the Seller, the refunded amount (and any return shipping) is deducted from the Seller's earnings or must be repaid by the Seller.

12.8 Taxes and licences. Sellers are responsible for any licences, taxes and registrations that apply to their own business.

12.9 Content licence. Sellers grant Artsadeem a non-exclusive, royalty-free licence to display, reproduce and adapt their listing images and texts on the Platform and in Artsadeem's marketing for as long as the listing is active and for a reasonable period afterwards. Sellers keep their copyright.

13. REVIEWS AND USER CONTENT

13.1 Only Buyers who purchased an Item can review it. Reviews must be honest and must not contain offensive, false or personal information.

13.2 You keep ownership of content you upload, but grant us a licence to host and display it on the Platform. We may remove content that breaks these Terms or the law.

14. INTELLECTUAL PROPERTY

14.1 The Platform, its design, software, texts and the Artsadeem name and logo belong to Artsadeem Trading or its licensors.

14.2 Artists keep the copyright in their works. Buying an original artwork transfers ownership of the physical work only; it does not transfer copyright or reproduction rights unless the Seller agrees otherwise in writing.

15. ACCEPTABLE USE

You must not: break the law or these Terms; misuse payment methods; harass other users; contact users to complete sales outside the Platform; scrape, overload or attack the Platform; upload malware; or create false accounts or reviews.

16. AI FEATURES

Some tools (such as listing suggestions, price suggestions and the exhibition guide) use artificial intelligence that runs on Artsadeem's own servers. AI output is a suggestion only, may be inaccurate, and must be checked by the user. Sellers remain responsible for their listings.

17. LIABILITY

17.1 We take reasonable care to keep the Platform available and secure, but we do not guarantee uninterrupted access.

17.2 Nothing in these Terms excludes or limits any liability or consumer right that cannot be excluded or limited under UAE law.

17.3 Subject to clause 17.2, Artsadeem is not liable for indirect or consequential loss, or for loss caused by events outside our reasonable control (such as carrier, customs, network or power failures, natural events or government action).

18. SUSPENSION AND TERMINATION

You may close your account at any time from your profile settings. We may suspend or close an account, remove listings or withhold payouts linked to fraud or a serious breach of these Terms, while the matter is investigated. Orders already placed are completed or refunded according to our policies.

19. COMPLAINTS

19.1 Contact us at [email protected], on +971 50 363 2373, through the contact page, or through "Report a problem" on your order. We acknowledge complaints within 2 business days and aim to resolve them within 14 days.

19.2 If you are not satisfied with our answer, you may contact the consumer protection authority of the Department of Economy and Tourism in Dubai (www.consumerrights.ae) or the UAE Ministry of Economy.

20. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. The courts of Dubai have jurisdiction over any dispute, without prejudice to your right to contact the competent consumer protection authority.

21. LANGUAGE

These Terms are published in Arabic and English. If the two versions differ, the Arabic version prevails.
