1. WHO WE ARE
Art Sadeem (“Platform”, “we”, “us”) operates an online marketplace connecting buyers with independent sellers of art, creative products, courses, and related content. We are not the seller of third-party listings unless expressly stated.
2. ACCEPTANCE
By accessing or using the Platform, creating an account, listing items, or placing an order, you agree to these Terms and our Privacy Policy and Refund Policy. If you do not agree, do not use the Platform.
3. ELIGIBILITY & ACCOUNTS
You must provide accurate information, safeguard your credentials, and notify us of unauthorised use. We may suspend or terminate accounts that violate these Terms or applicable law.
4. MARKETPLACE MODEL
4.1 Sellers are responsible for their listings, pricing, stock/availability, descriptions, images, legality of items, shipping where applicable, and fulfilment.
4.2 The Platform provides infrastructure (listing, checkout, payments facilitation, messaging as available) and may charge commissions or fees as disclosed at checkout or in seller onboarding.
4.3 Nothing in these Terms makes the Platform the owner of inventory listed by sellers unless we explicitly sell as principal.
5. LISTINGS, PRICING & AVAILABILITY
5.1 Sellers must state accurate quantities/stock and update listings when items are no longer available.
5.2 Prices are set by sellers unless we run a stated promotion. Taxes, duties, or customs may apply depending on jurisdiction; buyers are responsible for understanding import obligations where relevant.
5.3 We may remove or moderate listings that appear unlawful, misleading, infringing, or harmful.
6. ORDERS & PAYMENT
6.1 An order is created when a buyer completes checkout. Payment is captured only through authorised flows (e.g. card or other methods we enable).
6.2 Until payment is successfully completed, an order may remain “pending” and does not constitute a completed sale for payout or stock finalisation purposes.
6.3 You authorise us and our payment partners to charge applicable amounts and fees.
7. SHIPPING & DIGITAL DELIVERY
Physical items: shipping terms follow the listing and checkout disclosure. Digital goods or access (e.g. courses): delivery is as described on the product page. Risk and title pass as stated under applicable law and listing terms.
8. PROHIBITED CONDUCT
You will not: violate UAE or applicable export laws; infringe IP; upload malware; harass users; circumvent fees; manipulate reviews; launder money; or use the Platform for fraud.
9. INTELLECTUAL PROPERTY
Platform software, branding, and content we create are ours or our licensors’. Sellers grant us a licence to display listing content for operating the marketplace. Buyers receive only the rights expressly granted by sellers/licences for purchased items.
10. DISCLAIMERS
The Platform is provided on an “as is” and “as available” basis to the maximum extent permitted by UAE law. We do not warrant uninterrupted operation or error-free service.
11. LIMITATION OF LIABILITY
To the extent permitted by UAE Federal Law No. 15 of 2020 on Consumer Protection and other mandatory rules, our aggregate liability arising out of these Terms is limited as permitted by law. Nothing excludes liability that cannot legally be excluded.
12. GOVERNING LAW & DISPUTES
These Terms are governed by the laws of the United Arab Emirates. Disputes shall be subject to the exclusive jurisdiction of the courts of [INSERT EMIRATE / ONSHORE UAE], without prejudice to mandatory consumer rights.
13. CHANGES
